TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and Platinum Website Builders, a sole proprietorship operating EZPickleballStats at ezpickleballstats.com (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

EZPickleballStats provides pickleball statistics and analytics, and management tools for leagues, tournaments, ladders, box leagues, and open-play events — including registration, scheduling, court assignment, match results, and standings. Features vary by plan (Free, Pro, Host/Venue tiers).

3. Accounts and Responsibilities

• You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
• You must be at least 13 years old to use the Service.
• Match results and statistics you or your organizers record become part of shared league/tournament records visible to other participants.

4. Subscriptions and Billing

• Paid plans (including the Pro player subscription) are billed through Stripe. New Pro subscriptions may include a free trial; you will not be charged until the trial ends.
• Subscriptions renew automatically until cancelled. You can cancel any time from your subscription page; access continues through the end of the paid period.
• Refunds: Subscription fees are non-refundable except where required by law. You may cancel at any time from your subscription page to prevent future charges; your access continues through the end of the current paid period. Entry fees for events are handled by the organizing host or venue and are subject to their refund policy.

5. Hosts, Venues, and Entry Fees

• Organizers ("hosts" and "venues") may collect entry fees through the Service using Stripe Connect. The platform deducts a service fee from payments collected; the current fee is disclosed at the point of collection setup.
• Hosts are solely responsible for their events — including scheduling, conduct, cancellation, and any refunds owed to their participants. EZPickleballStats is not a party to the transaction between hosts and players.
• Hosts must comply with applicable laws and Stripe's terms when collecting payments.

6. Acceptable Use

You agree not to:

• Break the law, infringe others' rights, or submit false match results to manipulate standings or ratings;
• Harass or abuse other players, organizers, or staff;
• Attempt to access other users' accounts or data, probe or disrupt the Service, or scrape it at scale;
• Use the Service to send spam or unsolicited communications.

We may suspend or terminate accounts that violate these Terms.

7. Communications and SMS

We send transactional email related to your account and activity. Text messages (court assignments and match updates) are sent only if you explicitly opt in from your profile; message frequency varies with your event participation, message and data rates may apply, and you can reply STOP to opt out or HELP for help at any time. Full details, including our commitment not to share your mobile number or opt-in consent with third parties for marketing, are in the Privacy Policy.

8. Intellectual Property

The Service, its design, and software are owned by Platinum Website Builders. You retain rights to the content you submit and grant us a license to host and display it as needed to operate the Service (e.g., showing your results in league standings).

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, error-free statistics, or the conduct of any league, event, host, or player. Pickleball is a physical activity — you participate in events at your own risk, and we are not responsible for injuries or disputes arising at events organized through the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Platinum Website Builders will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Platinum Website Builders from claims arising out of your use of the Service, your events (if you are a host), or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in New York.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above; continued use of the Service after changes take effect constitutes acceptance.
